Faptele de h\u0103r\u021buire pot atrage r\u0103spundere disciplinar\u0103, contraven\u021bional\u0103 sau chiar penal\u0103<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe71b8c exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"fe71b8c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Este interzis orice comportament ostil, verbal sau nonverbal, care are drept scop sau efect lezarea demnit\u0103\u021bii unei persoane.<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1cf89e4 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"1cf89e4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Legisla<\/strong><strong>\u021b<\/strong><strong>ia <\/strong><strong>\u00ee<\/strong><strong>n vigoare privind discriminarea<\/strong><\/p><ul><li>Codul Muncii (Legea nr. 53\/2003), care interzice orice form\u0103 de discriminare direct\u0103 sau indirect\u0103\u00een rela\u021biile de munc\u0103.<\/li><li>Legea nr. 167\/2020, privind prevenirea \u0219i sanc\u021bionarea tuturor formelor de h\u0103r\u021buire moral\u0103 la locul de munc\u0103.<\/li><li>Legea nr. 202\/2002, privind egalitatea de \u0219anse \u0219i de tratament \u00eentre femei \u0219i b\u0103rba\u021b<\/li><li>G. nr. 137\/2000, privind prevenirea \u0219i sanc\u021bionarea tuturor formelor de discriminare.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-362e3de exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"362e3de\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Codul Penal<\/strong><\/p><p>Potrivit art. 369 din Codul Penal:\u00a0\u201eIncitarea publicului, prin orice mijloace, la violen\u0163\u0103, ur\u0103 sau discriminare \u00eempotriva unei categorii de persoane sau \u00eempotriva unei persoane pe motiv c\u0103 face parte dintr-o anumit\u0103 categorie de persoane definit\u0103 pe criterii de ras\u0103, na\u0163ionalitate, etnie, limb\u0103, religie, gen, orientare sexual\u0103, opinie ori apartenen\u0163\u0103 politic\u0103, avere, origine social\u0103, v\u00e2rst\u0103, dizabilitate, boal\u0103 cronic\u0103 necontagioas\u0103 sau infec\u0163ie HIV\/SIDA <u>se pedepse<\/u><u>\u015fte cu \u00eenchisoare de la 6 luni la 3 ani sau cu amend\u0103.\u201d<\/u><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe2a318 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"fe2a318\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Ce este discriminarea?<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9d4f68e exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"9d4f68e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>DISCRIMINAREA<\/strong> \u00a0&#8211; Spre deosebire de discriminarea direct\u0103, nu este evident\u0103 la prima vedere. <u>Sunt exceptate cazurile \u00een care aceste prevederi, criterii sau practici sunt justificate obiectiv de un scop legitim, iar metodele de atingere a acelui scop sunt adecvate \u0219i necesare<\/u>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b2deac9 religioase.<\/li><li>Repartizarea g\u0103rzilor\/turelor \u201e\u00een ordine alfabetic\u0103\u201d, ceea ce poate afecta dispropor\u021bionat angaja\u021bii din anumite etnii, dac\u0103 numele lor \u201ebully\u201d, care \u00eenseamn\u0103 b\u0103t\u0103u\u0219, huligan. <\/em><em>Conceptul de \u201dbullying\u201d reprezint\u0103 o form\u0103 de abuz emo\u021bional \u0219i fizic.<\/em><\/p><p><strong>H\u0103r\u021buire moral\u0103 la locul de munc\u0103,<\/strong>\u00a0\u00een \u00een\u021belesul\u00a0<a href=\"https:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/228723\"><strong>Legii nr. 167\/2020\u00a0<\/strong><\/a>privind prevenirea \u0219i sanc\u021bionarea tuturor formelor de h\u0103r\u021buire psihologic\u0103 la locul de munc\u0103:<\/p><p>Orice comportament exercitat cu privire la un angajat (\u2026) care s\u0103 aib\u0103 drept scop sau efect o deteriorare a condi\u021biilor de munc\u0103 prin lezarea drepturilor sau demnit\u0103\u021bii angajatului, prin afectarea s\u0103n\u0103t\u0103\u021bii sale fizice sau mentale ori prin compromiterea viitorului profesional al acestuia, comportament manifestat \u00een oricare dintre urm\u0103toarele forme: conduit\u0103 ostil\u0103 sau nedorit\u0103; comentarii verbale; ac\u021biuni sau gesturi.<\/p><p>Orice comportament care, prin caracterul s\u0103u sistematic, poate aduce atingere demnit\u0103\u021bii, integrit\u0103\u021bii fizice ori mentale a unui angajat sau grup de angaja\u021bi, pun\u00e2nd \u00een pericol munca lor sau degrad\u00e2nd climatul de lucru. \u00cen \u00een\u021belesul prezentei legi, stresul \u0219i epuizarea fizic\u0103 intr\u0103 sub inciden\u021ba h\u0103r\u021buirii morale la locul de munc\u0103.<\/p><p>Constituie h\u00e2r\u021buire \u015fi se sanc\u0163ioneaz\u0103 contraven\u0163ional orice comportament pe criteriu de ras\u0103, na\u0163ionalitate, etnie, limb\u0103, religie, categorie social\u0103, convingeri, gen, orientare sexual\u0103, apartenen\u0163\u0103 la o categorie defavorizat\u0103, v\u00e2rst\u0103, handicap, statut de refugiat ori azilant sau orice alt criteriu care duce la crearea unui cadru intimidant, ostil, degradant ori ofensiv.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-88d39c8 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"88d39c8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Exemple<\/strong><\/p><ul><li>manifestarea sau diseminarea unui material ofensator sau cu con\u021binut indecent;<\/li><li>insinu\u0103ri, batjocur\u0103, glume sau remarci obscene ori sexiste\/rasiste\/homofobe;<\/li><li>folosirea unui limbaj ofensator \u00een descrierea unei persoane cu dizabilitate sau ironizarea unei persoane cu dizabilitate;<\/li><li>comentarii despre aspectul fizic sau caracterul unei persoane, de natur\u0103 s\u0103 cauzeze st\u00e2njeneal\u0103 sau suferin\u021b\u0103;<\/li><li>aten\u021bie nedorit\u0103, precum spionare, urm\u0103rire permanent\u0103, \u0219icanare, comportament exagerat de familiar sau aten\u021bie verbal\u0103 ori fizic\u0103 nedorit\u0103;<\/li><li>efectuarea sau trimiterea de: apeluri telefonice, SMS-uri, e-mailuri, mesaje pe re\u021belele sociale, faxuri sau scrisori nedorite, cu conota\u021bii sexuale, ostile sau care invadeaz\u0103 via\u021ba privat\u0103 a unei persoane;<\/li><li>\u00eentreb\u0103ri nejustificate, inoportune sau persistente despre v\u00e2rsta, starea civil\u0103, via\u021ba personal\u0103, interesele sau orientarea sexual\u0103 a unei persoane, ori \u00eentreb\u0103ri similare despre originea rasial\u0103 sau etnic\u0103 a unei persoane, inclusiv despre cultura sau religia acesteia.<\/li><li>avansuri sexuale nedorite, solicit\u0103ri repetate de acordare a unei \u00eent\u00e2lniri, sau amenin\u021b\u0103ri;<\/li><li>sugestii privind faptul c\u0103 favorurile sexuale \u00eei pot aduce unei persoane promovarea profesional\u0103 sau c\u0103, dac\u0103 aceasta nu le acord\u0103, atunci cariera sa va avea de suferit;<\/li><li>priviri insistente, gesturi grosolane, atingeri, apuc\u0103ri sau alte tipuri de contact corporal nenecesar, precum atingerea \u00een treac\u0103t de alte persoane;<\/li><li>r\u0103sp\u00e2ndirea de zvonuri mali\u021bioase sau insultarea unei persoane (\u00een special pe motive de v\u00e2rst\u0103, ras\u0103, c\u0103s\u0103torie, parteneriat civil, sarcin\u0103 \u0219i maternitate, sex, dizabilitate, \u0219i religie sau credin\u021b\u0103).<\/li><li>apar \u0219i exemple de expresii vehiculate frecvent la job,\u00a0\u201epentru a scuza, a defini sau a face referire la comportamente sau situa\u021bii existente \u00eentre persoane la locul de munc\u0103, acestea put\u00e2nd semnifica o persecutare ascuns\u0103\u201d:<\/li><li>\u201eciocnire \u00eentre personalit\u0103\u021bi\u201d \u2013 pentru descrierea unei rela\u021bii profesionale;<\/li><li>\u201emult prea sensibil\u0103\u201d sau \u201ecare nu gust\u0103 glumele\u201d sau \u201eo problem\u0103 de atitudine\u201d \u2013 pentru a caracteriza o persoan\u0103;<\/li><li>\u201enu-i tolereaz\u0103 u\u0219or pe pro\u0219ti\u201d\u2013 pentru a descrie comportamentul unui coleg sau unui manager.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad5f7a3 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"ad5f7a3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #605be5;\"><strong>DISCRIMINAREA<\/strong> <strong>MULTIPL\u0102<\/strong><\/span><\/p><p>Orice deosebire, excludere, restric\u021bie sau preferin\u021b\u0103 bazat\u0103 pe dou\u0103 sau mai multe criterii, constituie circumstan\u021b\u0103 agravant\u0103 la stabilirea r\u0103spunderii contraven\u021bionale dac\u0103 una sau mai multe dintre componentele acesteia nu intr\u0103 sub inciden\u021ba legii penale.<\/p><p>discriminarea multipl\u0103 poate fi:<\/p><p><strong><em>Cumulativ\u0103<\/em><\/strong>: atunci c\u00e2nd efectele specifice pot fi distinse.<\/p><p>\u00a0De exemplu, o femeie rom\u0103 poate fi discriminat\u0103 la locul de munc\u0103 pe criterii de sex \u015fi \u00een leg\u0103tur\u0103 cu accesul la asisten\u0163\u0103 medical\u0103 din cauza etniei;<\/p><p><em><strong>Intersec\u0163ional\u0103<\/strong>:<\/em> atunci c\u00e2nd discriminarea este bazat\u0103 pe combinarea a dou\u0103 sau mai multe caracteristici.<\/p><p>De exemplu, c\u00e2nd o femeie de etnie rom\u0103 na\u015fte \u00eentr-un spital, ea poate fi discriminat\u0103 nu numai pentru c\u0103 este femeie (nu toate femeile se confrunt\u0103 cu o astfel de discriminare) \u015fi nu numai din cauza etniei rome (nu to\u0163i romii se confrunt\u0103 cu aceast\u0103 problem\u0103), ci din cauza combin\u0103rii a dou\u0103 caracteristici.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b07a97 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" style=\"color: #605be5;\"><strong>VICTIMIZAREA<\/strong><\/span><\/p><p>Potrivit art. 2 alin. (7) din O.G. nr. 137\/2000,\u00a0<em>\u201econstituie victimizare\u201d \u0219i se sanc\u021bioneaz\u0103 contraven\u021bional orice tratament advers,\u00a0<\/em><a href=\"https:\/\/legeaz.net\/legea-416-2001-venitul-minim-garantat\"><em>venit<\/em><\/a><em>\u00a0ca reac\u021bie la o pl\u00e2ngere sau ac\u021biune \u00een justi\u021bie cu privire la \u00eenc\u0103lcarea principiului tratamentului egal \u0219i al nediscrimin\u0103rii.<\/em>\u00a0Victimizarea, \u00een condi\u021biile O.G. nr. 137\/2000, republicat\u0103, se poate invoca \u00een situa\u021bia \u00een care exist\u0103 un tratament advers ca urmare a unei pl\u00e2ngeri av\u00e2nd ca obiect\u00a0<a href=\"https:\/\/legeaz.net\/og-137-2000-discriminare\/\">discriminare<\/a>a.<\/p><p>Victimizarea reprezint\u0103 o form\u0103 de discriminare pentru existen\u021ba c\u0103reia se cer \u00eendeplinite cumulativ trei condi\u021bii, \u0219i anume: existen\u021ba unui tratament advers fa\u021b\u0103 de o persoan\u0103, respectivul tratament s\u0103 aib\u0103 drept cauz\u0103 introducerea unei pl\u00e2ngeri sau ac\u021biuni \u00een justi\u021bie, iar acestea s\u0103 vizeze \u00eenc\u0103lcarea principiului tratamentului egal \u0219i al nediscrimin\u0103rii. \u201eManifestarea unui comportament contrar sau advers \u00eempotriva persoanei care formuleaz\u0103 peti\u021bii \u0219i ac\u021biuni \u00een justi\u021bie poate fi calificat\u0103 ca o fapt\u0103 de victimizare\u00a0<em>numai<\/em>\u00a0\u00een situa\u021bia \u00een care este determinat\u0103 de invocarea \u00een cadrul respectivei proceduri a \u00eenc\u0103lc\u0103rii anterioare a principiului egalit\u0103\u021bii de tratament \u0219i al nediscrimin\u0103rii, \u00een absen\u021ba acestui obiect al procesului nefiind incidente dispozi\u021biile O.G. nr. 137\/2000.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-44d0d0f exad-glass-effect-no elementor-widget elementor-widget-text-editor\" <strong>AFIRMATIV\u0102<\/strong><\/span><\/p><p>Ordonan\u021ba mai prevede c\u0103 m\u0103surile luate de autorit\u0103\u0163ile publice sau de persoanele juridice de drept privat \u00een favoarea unei persoane, unui grup sau a unei comunit\u0103\u0163i, viz\u00e2nd asigurarea dezvolt\u0103rii lor fire\u015fti \u015fi realizarea efectiv\u0103 a egalit\u0103\u0163ii de \u015fanse a acestora \u00een raport cu celelalte persoane, grupuri de persoane sau comunit\u0103\u0163i, precum \u015fi m\u0103surile pozitive ce vizeaz\u0103 protec\u0163ia grupurilor defavorizate nu constituie discriminare.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e19e873 exad-glass-effect-no elementor-widget elementor-widget-text-editor\" style=\"color: #605be5;\"><strong>DREPTUL LA DEMNITATEA PERSONAL\u0102<\/strong><\/span><\/p><p>Orice comportament manifestat \u00een public, av\u00e2nd caracter de propagand\u0103 na\u0163ionalist-\u015fovin\u0103, de instigare la ur\u0103 rasial\u0103 sau na\u0163ional\u0103, ori acel comportament care are ca scop sau vizeaz\u0103 atingerea demnit\u0103\u0163ii ori crearea unei atmosfere de intimidare, ostile, degradante, umilitoare sau ofensatoare, \u00eendreptat \u00eempotriva unei persoane, unui grup de persoane sau unei comunit\u0103\u0163i \u015fi legat de apartenen\u0163a acestora la o anumit\u0103 ras\u0103, na\u0163ionalitate, etnie, religie categorie social\u0103 sau la o categorie defavorizat\u0103 ori de convingerile, sexul sau orientarea sexual\u0103 a acestuia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-748066d exad-glass-effect-no elementor-widget elementor-widget-text-editor\" data-id=\"748066d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #605be5;\"><strong>CERIN\u0162E OCUPA\u0162IONALE SPECIFICE<\/strong><\/span><\/p><p>\u00cen anumite situa\u0163ii, impunerea unor criterii de selec\u0163ie aparent discriminatorii poate fi justificat\u0103. Ordonan\u0163a recunoa\u015fte dreptului angajatorului de a refuza angajarea unei persoane care nu corespunde cerin\u0163elor ocupa\u021bionale \u00een domeniul respectiv, at\u00e2t timp c\u00e2t refuzul nu constituie un act de discriminare \u00een sensul prezentei ordonan\u0163e, iar aceste m\u0103suri sunt justificate obiectiv de un scop legitim \u015fi metodele de atingere a acelui scop sunt adecvate \u015fi necesare<\/p><p>Discriminarea poate s\u0103 aib\u0103 mai multe forme, dar toate acestea au un impact devastator asupra persoanelor implicate, supuse acestor tratamente nejustificate.
